Welcome to our Terms of Service Agreement.
When registering or ordering service from this company you the “Customer” are required to keep up to date with changes in our policy and service guidelines. It is your responsibly to read our terms of service completely. If you do not understand any part of our terms please let us know.

1. Definitions
“Customer” A person or group purchasing or about to purchase service with ET Game Hosting.com. “Company” The site and/or services of ET Game Hosting.com. “Game Server” A single application process hosted on a single internet server over the internet for entertainment and/or recreational purposes.

2. Responsibility Guidelines
a. Company Responsibilities –
We are responsible for the maintenance and uptime of our network and hardware. We will provide the Customer with a complete running and ready to play on Game Server at time of order setup with Game of Choice as ordered, Web Based Game Control Panel to Stop/Start Game Server and access to modifiable server files, High Quality Network performance based on the location of your server hosting, 95% Uptime Guarantee (See 95% uptime guarantee section 5 below), 24 hours server management and/or ftp access to modify server files and configurations, 24 hour onsite hardware and network connectivity uptime monitoring, Friendly Support from our Technical Support Staff via Online Support Ticket System. Hardware and Network where servers are hosted are monitored 24/7 the game server application are not monitored themselves by a human however, if there is a problem created by the customer changing files on the game server our control panel software will attempt to restart the game server 5 times automatically. If the customer has a problem after changing files on the Game Server they are required to notify support staff by Online Support Ticket System. We are obligated to provide you with fast efficient support for your hosted game application. We monitor all game server systems to ensure all systems running game server applications stay up 24 hours a day, 365 days a year and monitor many areas of server system processes including CPU, Memory, Network usage in real time to eliminate hardware overload issues assuring the best game performance possible on server hardware for our customers enjoyment.
b. Customer Responsibilities -
You are responsible for the upkeep of your server. Including but not limited to adding additional custom maps (Stock maps are included at setup time) by transfering files to your server, game play related files and server configuration modifications. (Support Staff is available by online support ticket system to answer questions to help you admin your game server), If your game server application is down you are required to notify us as soon as possible via a support ticket found on our web site to make sure your game server is back online. We do not monitor game servers on an individual basis, however our server management system will restart servers if they crash and gives you control to remotely restart your game server in the event, it freezes or you make configuration changes that require a restart. We want to help limit the amount of downtime you may experience due to server crashes etc. because of changes you may make to your server configuration. You must insure that your server abides by our term of service at all times.
c. Paying for service - All payments are due before service is rendered. A service month is 30 days. Subscription payments by Paypal are automatically billed with a receipt email going to the customers paypal email every 30 days. Those that pay by mail must make sure that the next months payment has been recieved before the next billing date. If you no longer want service you are required to contact Sales Dept. with cancellation request including Game Server IP in the email. Requests to discontinue service must be entered no later then 3 days before your next payment date to avoid additional service charges. There are no refunds for remainder of the month's unused service unless this is a new server setup. (Please see Section 5 at the bottom of this page for details on Refund Policy and when Refunds may be offered to the Customer)
d. Passworded (Private) and Public Game Servers -
If you ordered a password protected game server your server must remain passworded at all times thus making it a "Private" passworded server. Your Private server password may not be advertised to the general public by adding password to your server Hostname, on public forums or other method but may be posted in order to notify your clan members the proper password. Private Server passwords may not be posted in the server name. Our password protected game servers (Private Server) is designed for clan use only and is not intending to be used as a public game server. Private Servers found without a private password set may be found in violation of the terms of service agreement. Private (passworded) Servers are cheaper and generally used for clan matches, practices etc. Public Servers are not passworded available to anyone in the public not knowing a password to join and play on. Public servers can have no password set and may be freely changed from password protected to public at your command.
e. Player Limits -
To provide everyone with a value dedicated game server there are limits on the number of players based on the Game Server service you applied for. If you adjust your player limit higher that you have paid for you may be found in violation of this terms of service agreement. You may at any time request an upgrade to a larger slot server by contacting Sales Dept.. Violations may result in immediate termination of service without refund.
f. In game bots -
We understand how some people enjoy running bots on there servers. However bots do take extra server resources when the server is not in use. Our Server pricing is based on normal usage by human players. We may allow up to 4 bots running on a game server if bots are supported by the base game install. If bots above what are allowed are found running on your game server you could be found in Violation of our Term of Service (TOS).
g. Restricted Files, Mods, Plugins, etc. -
We reserve the right to remove alter or deny some files that cause performance related problems with your server.
"Supported Mods" - are mods listed on the order pages for each game server type. If you do not see a mod you are interested in please ask us before order.
"3rd Party Plugins" - 3rd Party Plugins are additional addon plugins that can run with a mod but are not included in the full install of the mod from the original developer but an addon made by a 3rd party developer (Another person besides the original mod creators). We only provide limited support for 3rd Party Plugins since they may or may not have been tested by the 3rd party developer to work properly with the normal mod. When we install mods at setup time example: Adminmod, AMX etc. they already come with the official mod plugins created by the developer. If you have questions about this please contact us.
h. Order Setup Times -
95% of orders are activated within 2 to 8 hours of payment confirmation. If for some reason your setup has not been completed within 24 Hours after recieving payment we will give you the option of added credit to your account or full refund. Based on order volume and space some orders may take longer then others.
i. Game Server Software Liability -
ET Game Hosting.com is not responsible for limitations within some games limiting password protection, file modification, FTP access restrictions, or any other design control that is not allowed by some game server software. All issues with software design must be handled via the proper developer web site. It is your responsibility to contact us about any important questions you have about your game server prior to purchase if you feel there limitations that are important to you. ET Game Hosting.com hosting fees are to cover space, bandwidth expense and our staff costs. ET Game Hosting.com hosting fees do not cover the game itself or how it operates outside of the standard game setup.

3. FTP Access Guidelines
Server Files - FTP access is not to be used for anything other than files related specific to your game server usage. All users of our service are responsible for their files and content of their servers. Game Server installs come as a basic setup. Additional files and add-ons must be applied by the customer as long as they comply with this TOS agreement. Please change your server files with care. We are not responsible for the files in your game server directories after your game server account is activated. We strictly forbid storing of porn, or other unnecessary/Illegal files on the game server FTPs. The Customer understands that we strongly recommend they not share their private FTP password with anyone since this may allow others to render their game server inoperable and cause our support staff to need to reload all game files at the customers expense. We reserve the right to delete information from your game install if is does not comply with this TOS agreement.
Data Security and Backups - You are solely responsible for any and all backups of your data. ET Game Hosting.com may not be held accountable for any loss of data due to hardware or software failure. ET Game Hosting.com highly recommends keeping backup copies of files, configurations, mods and other important files on your local computer.

4. Payments and Paying for Service
Payment Processing - All payment collection is done by ET Game Hosting.com. when paying via credit card the name on your statement will appear as ETGAMEHOST. If you have questions about your billing you may contact ET Game Hosting directly at 415-626-1553.
Payment Methods Accepted - We accept payment by credit cards and eCheck via Paypal and Cashiers Check or Money Order by mail. (Contact Sales Dept. for info on how to pay by mail)
Payment via Paypal - When paying via Paypal on Subscription service all service dues will be auto deducted for monthly services (every 30 days) until you cancel service. You will be emailed a monthly reciept for all charges. We will continue to charge you for service until you cancel. All billing is reoccurring based on the terms of service you specified upon sign-up.
Payment Terms - A billing month is based on a 30 day period. All service payments must be made before service is rendered. Payment for service beyond your first payment must be made on or before you next billing date. For paypal users this is done automatically. If at any time you have questions about when your next bill is due you may e-mail or call the staff of this site.
Payment Failure - If customer fails to pay or payment does not clear for a month of service the customer will be contacted by email in order to attempt to correct the issue. If payment is not made the customers account may be suspended or cancelled for fail to pay.
Service Changes - You may change, upgrade or downgrade your service at anytime. Additional fees may apply for service upgrades if you are upgrading service in the middle of your current billing cycle. There are no prorated service credits for service downgrades.
Setup Fees - There are no server setup fees for server setups for new game server orders.
Additional Service Charges - There may be an additional $5 fee charged to the customer if the customer has rendered their game server unusable by deleting required game system files or other reason where it requires a full game install again to render the game server usable again as was first provided to the customer. There may also be a $5 charge for setup in a different datacenter location at customers request other than what was provided (selected) at server order time.
Canceling Service - You may cancel your service at anytime. In order to cancel service we require you to contact Sales Dept. by email including your game server's IP address related to your account no later then 3 days before your next billing period to avoid additional service charges. Upon canceling your service will continue until your current billing period ends. We will assume you want to continue service until you cancel your account. There are no refunds on unused service for the remainder of the monthly billing period but for the new customer exception and 95% uptime guarantee as stated in Refund Policy below in Section 5.


5. Service Level Agreements and Refund Policies
95% Uptime Guarantee - ET Game Hosting.com will provide 95% network and server hardware uptime based on 30 day period over the month.
Refund Policy - You are eligible for a refund if we do not maintain 95% network uptime based on a 30 day period over the system your service is hosted on you are then eligible for a prorated refund less a $15.00 early termination fee to cover admin costs. While your ping times will be more than enjoyable on our service we will not issue refunds that are due to ping issues with you or your server members. Since there are so many ways to travel on the internet it would be impossible for anyone to guarantee internet ping times. We do our best to host your game server on the best bandwidth quality as possible. All refunds are based on a prorated remainder of your service time and may only be requested by contacting Sales Dept.
New Customer Refunds - New Customers may cancel service for any reason within the first 5 days of original new service and recieve a refund minus $15 admin fee. Beyond the first 5 days of new service customers may cancel within 3 days prior to next billing date and not be billed again on the next billing period but no pro-rated refund will be offered with the exception of the 95% uptime guarantee.
Voice Server Refunds - Voice Servers come free with Game Servers. For those voice servers purchased seperately there will be no refunds due on cancellation unless we do not maintain the 95% uptime guarantee over a 30 day period which then you may recieve a pro-rated refund. All other voice server cancellations should be done no later than 3 days prior to the next monthly billing period.
Service Credits - We will credit your account if your server is down for a period of time of more then 4 hours in any given day due to hardware or network issues. Credits will be determined by our staff at the time of the issue and will be credited directly to your online account once the issue is resolved. Service credits may not be paid in cash, or refunded to credit cards.

6. Promotional Terms and Special Offers
Promotional and Special offers are treated as exceptions to other parts of our terms of service. Promotional and Special offers may have limited term guidelines.
Special Pricing - Discounted or promotional Special rates at signup are valid until the customer cancels or fails to pay for service.

7. Additional Terms
Pricing Subject to Change - Prices are subject to change with little or no notice at anytime. In order to be subject to new lower pricing your much cancel your current account and reorder under new pricing.
Upgrades and Patches - We will patch your server as needed by the game designers at no charge to you. Game Servers are setup with the base install according to the game type ordered. The price you pay when signing for service will remain in effect until you cancel.
Failure to Comply - Failure to comply with all current and future Terms of Service Agreements can result in termination of your account and/or service interruption. We reserve the right to discontinue your service of a server if we find your server is in violation of our Terms of Service, until the account holder insures us his/her game server does comply to our Terms of Service. If service termination is in order your service can be terminated without refund. Liability: IN NO EVENT WILL ET Game Hosting.com BE LIABLE TO CUSTOMER FOR ANY CONSEQUENTIAL, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL DAMAGES OR ANY LOSS OF PROFIT, REVENUE, DATA OR GOODWILL WHETHER INCURRED OR SUFFERED AS A RESULT OF UNAVAILABILITY OF THE SERVICES, PERFORMANCE, NONPERFORMANCE, NEGLIGENCE, TERMINATION, BREACH OR ACTION OR INACTION UNDER THIS AGREEMENT EVEN IF CLIENT ADVISES ET Game Hosting.com OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. THE FOREGOING LIMITATION ON LIABILITY, HOWEVER, SHALL NOT RELIEVE ET Game Hosting.com FROM LIABILITY FOR DIRECT DAMAGES ARISING SOLELY OUT OF ET Game Hosting.com's GROSS NEGLIGENCE OR WANTON OR WILLFUL MISCONDUCT IN PERFORMANCE OF THE HOSTING SERVICES.
